01Acceptance of terms
These Terms & Conditions ("Terms") govern your access to and use of the WatchPoint mobile application (the "App"), operated by WatchPoint ("we," "us," or "our"). By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
02The service
WatchPoint provides AI-assisted authentication, identification, and market valuation for luxury watches, based on photos and reference/serial numbers you submit. Results are generated using a combination of automated analysis and market data, and are provided as informational tools.
03Purchases & subscriptions
Reports and subscriptions are purchased through the Apple App Store or Google Play, and are billed and processed according to their respective terms of service. Refunds, cancellations, and billing disputes are handled by Apple or Google in accordance with their policies — we do not directly process payments or issue refunds outside of those platforms.
Subscriptions renew automatically until cancelled. You can manage or cancel your subscription at any time through your device's app store account settings.
04Accuracy disclaimer
For high-value purchases, sales, insurance, or legal purposes, we recommend obtaining a physical inspection from an authorized dealer, a certified appraiser, or the watch manufacturer. WatchPoint is not liable for financial decisions made in reliance on App results.
05Acceptable use
You agree not to:
- Use the App for any unlawful purpose, including facilitating the sale of counterfeit goods
- Attempt to reverse-engineer, decompile, or extract the App's underlying models or data
- Submit photos or content you do not have the right to use
- Interfere with or disrupt the App's operation or security
- Misrepresent WatchPoint results as an official manufacturer certification
06Your content
You retain ownership of the photos and information you submit. By submitting content, you grant WatchPoint a limited license to use it to provide the App's features, including generating your authentication results and reports, and to improve our AI models on an aggregated or de-identified basis.
07Intellectual property
The App, including its design, software, AI models, and content (excluding your submitted content), is owned by WatchPoint and protected by intellectual property laws. You may not copy, modify, or distribute any part of the App without our permission.
08Termination
We may suspend or terminate your access to the App if you violate these Terms. You may stop using the App and delete it from your device at any time. Provisions that by their nature should survive termination (including the accuracy disclaimer and limitation of liability) will continue to apply.
09Disclaimer of warranties
The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that results will be accurate or complete.
10Limitation of liability
To the fullest extent permitted by law, WatchPoint shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits or financial loss, arising from your use of or inability to use the App, including reliance on any authentication or valuation result.
12Changes to these terms
We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above, and where appropriate, through an in-app notice. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.
